Le 46e congrès annuel du Barreau du Québec qui se tiendra les 30, 31 mai et 1er juin 2002 au Manoir Richelieu, dans la région de Charlevoix, convie avocates et avocats à venir prendre le temps… Au programme: formation haut de gamme sur des thèmes d’actualité juridique de pointe, bon air, beauté et douceurs, tout sera en place pour nourrir l’esprit, le corps et… l’âme des congressistes.

The 46th annual convention of the Quebec Bar, to be held May 30th, 31st and June 1st, 2002 at the Manoir Richelieu in the Charlevoix region, invites lawyers to come take the time … On the program: high-end training on topics of breaking legal news, fresh air, beauty and clemency, all will be in place to nourish the mind, body and… soul of the conventioners.

D’entrée, le congrès 2002 propose aux avocats de faire le tour d’une année dans la vie de la Cour suprême du Canada avec la juge Louise Arbour, qui participera, avec six autres invités, à la plenière d’ouverture du congrès, Une année dans la vie de la Cour suprême: la perception des médias.

For openers, the 2002 Conference invites lawyers to take a tour of a year in the life of the Supreme Court of Canada with Judge Louise Arbor, who with six other guests, will participate in the plenary opening of the Congress entitled: A Year in the Life of the Supreme Court: as Viewed by the Media.

Pour le président du comité organisateur de ce congrès, Me Danyel Laporte, la plénière offre aux juristes une occasion privilégiée de sortir de la pratique de tous les jours et de saisir la nature des relations entre le monde juridique et celui des médias. « À cette occasion, annonce Me Laporte, on y dévoilera les résultats partiels d’une enquête nationale, la première en son genre au Canada, portant sur la Cour suprême et ses relations avec les médias à la lumière de ses décisions liées à des questions sociales ou politiques. »

For the president of the Congress organizing committee, Maître Danyel Laporte, the plenary offers jurists a privileged opportunity to step outside of the daily practise and experience the nature of the relationship between the legal world and the media. “On this occasion,” says Maître Laporte, we will unveil the partiel results of a national study, the first of its kind in Canada, bearing on the Supreme Court and its relations with the media in light of its decisions linked to social or political questions.”

Trois membres de l’équipe de recherche partageront avec les congressistes leur analyse du matériel recueilli, soit tout ce qui a été publié au sujet de la Cour suprême, tant dans les journaux quotidiens nationaux qu’aux nouvelles nationales télévisées pour l’année 2000-2001. Il s’agit du Dr David Taras, professeur à l’Université de Calgary, Me Florian Sauvageau, professeur à l’Université Laval, et Me Valérie Langlois, chargée de projet.

Three members of the research team will share with conference attendees their analysis of the material gathered, i.e., everything that has been published on the the subject of the Supreme Court in the national daily papers as well as in the national televised news for the year 2000-2001. These are Dr. David Taras, Professor at the University of Calgary, Maître Florian Sauvageau, Professor at Laval University, and Maître Valérie Langlois, project director.

« Il sera question de la couverture journalistique mais aussi des attentes, contraintes et pressions qui existent entre journalistes, juges et avocats », ajoute Me Laporte. À cet égard, Me André Joli-Cœur, qui a agi comme procureur dans le renvoi sur l’indépendance du Québec devant la Cour suprême, apportera le point de vue du plaideur. Enfin, Me Alain-Robert Nadeau, docteur en droit constitutionnel et chroniqueur judiciaire au Journal du Barreau et au quotidien Le Devoir, et Daniel L’Heureux, correspondant parlementaire à RDI et à la Société Radio-Canada, réagiront et apporteront leurs commentaires du point de vue des médias. Le débat sera animé par Marc Laurendeau, journaliste à la SRC.

“It will be a question of the journalistic coverage but also of the expectations, constraints and pressures which exist among journalists, judges and lawyers”, adds Maître Laporte. In this respect, Maître Andre Joli-Coeur, who acted as prosecutor in the reference on the independence of Quebec before the Supreme court, will present the viewpoint of the litigant. Lastly, Maître Alain-Robert Nadeau, doctor of constitutional law and legal columnist to the Bar review (Journal du Barreau) and the daily newspaper Le Devoir, and Daniel L’Heureux, parliamentary correspondant for RDI and the Canadian Broadcasting Corporation, will respond and offer their opinions from the point of view of the media. The debate will be moderated by Marc Laurendeau, a journalist with the CBC.

« Les conférenciers expliqueront d’abord la nature des relations entre les journalistes et la Cour suprême, poursuit Me Laporte. Ils distingueront ensuite les causes « vedettes » au cours de cette année et feront le parallèle avec les causes laissées dans l’ombre avec, en toile de fond, une comparaison de la couverture de la presse écrite et de la presse télévisuelle au sein des médias, tant francophones qu’anglophones. »

“The lecturers will first explain the nature of the relationship between journalists and the Supreme court,” continues Maître Laporte. They will then single out the “featured” cases over the past year and will contrast these with cases left uncovered, in the background, a comparison of the coverage in the printed press and the televised press amongst the media, both French-speaking and English-speaking.”

Prendre le temps, c’est aussi prendre le chemin de la formation à la découverte d’ateliers pour juristes avertis mais aussi d’ateliers « nouveau genre » comme celui animé par le Dr Serge Marquis, Mes émotions mon équilibre: comment me protéger de moi-même. « Tous les avocats vivent avec le stress, constate Me Laporte, et nous sommes tous pris dans le tourbillon de la pratique. C’est pourquoi il est bon de s’arrêter pour penser à soi, à notre santé et faire le point. L’atelier du Dr Marquis a connu un vif succès l’année dernière. Il nous présente la suite et traite sur une note humoristique de la façon de gérer notre stress. »

To take time is also to take the path of training by discovering workshops for informed jurists “nouveau genre” workshops such as the one led by Dr. Serge Marquis, My emotions, my equilibrium: how to protect me from myself. “All lawyers live with stress,” notes Maître Laporte, and we all are caught up in the whirl of practice. This is why it’s good to stop and think of oneself, of our health and to take stock. Dr. Marquis’s workshop was a was a marked success last year. He presents the follow-up and deals humorously with the way to manage our stress.”

Are you ready for retirement? If you answer yes, you are in the minority. “By attending the workshop, Retirement, a journey without mishap, the young and the not-so-young will be able to have a clearer picture of the planning of this important stage of life”, suggests Maître Laporte.

Quel est l’impact du nouveau projet de loi 180 portant sur la divulgation de renseignements confidentiels en vue d’assurer la protection de personnes? Quatre conférenciers, dont le juge Michael Sheehan, animeront l’atelier Le secret professionnel oblige-t-il à fermer les yeux sur le suicide? Juge, avocat, psychologue, syndic proposeront aux avocats, pratiquant notamment en droit de la famille, des outils indispensables pour les aider à faire face à cette délicate problématique.

What is the impact of the new bill 180 on disclosure of confidential information with a view to ensuring the protection of persons? Four lecturers, including Judge Michael Sheehan, will lead the workshop Does professional secrecy oblige us to close our eyes to suicide? Judge, lawyer, psychologist, and syndic will propose to lawyers, in practitioner those practising in family law, indispensable tools to help face these delicate problems.

Or s’il est un atelier auquel le président du congrès vous convie c’est celui sur La facturation des services de l’avocat. « Cet atelier, avec des experts issus de différents milieux, proposera des modes alternatifs de rémunération des services juridiques. La perception des gens est que les avocats coûtent trop cher: il est temps de changer les mentalités. Les clients demandent de plus en plus une estimation du coût des services et l’avocat doit innover dans ce domaine. »

Do you know that billing at the hourly rate is used in over 95% of cases by lawyers in private practice? However if there is one workshop which the conference president encourages you to attend, it is the one on billing for the lawyer’s services. “This workshop, with experts from various milieux, will suggest alternative modes of remuneration for legal services. Peoples’ perception is that lawyers are too expensive: it is time to change mentalities. Clients increasingly demand an estimate of the cost of services and the lawyer must innovate in this area.”

Nouvelle tendance et nouvelle loi

On examinera aussi une nouvelle tendance au sein de la pratique professionnelle: Le justiciable qui se représente seul, le plaideur trop belliqueux et le phénomène de la quérulence. La juge en chef de la Cour supérieure, Lyse Lemieux, sera entourée d’un panel composé de professeurs, praticiens et d’un psychiatre, pour aborder les conséquences de ces nouveaux phénomènes.

We will also look at a new trend in professional practice: the self-represented litigant, the excessively bellicose litigant and the phenomenon of quarrelsomeness. The Chief Justice of Quebec Superior Court, Lyse Lemieux, will be accompanied by a panel composed of professors, practitioners and a psychiatrist, to tackle the consequences of these new phenomena.

Enfin, la nouvelle Loi sur le recyclage des produits de la criminalité fera l’objet d’un atelier. Il y sera question des répercussions que la mise en vigueur de la loi et de son Règlement sur la déclaration des opérations douteuses aura dans l’ensemble du milieu juridique. À souligner, en terminant ce bref aperçu parmi les quelque 25 ateliers au programme de ce congrès, la participation de la Division Québec de l’Association du Barreau canadien, qui présente l’atelier L’éthique du plaideur… Il n’y en aura pas de facile, avec pour conférencier Me Sylvain Lussier.

Lastly, the new Law on laundering the proceeds of criminality will be the subject of a workshop. The repercussions that the implementation of the law and its Regulations on the declaration of dubious operations will have on the legal field in general will be dealt with. To underscore, in concluding this brief outline of the 25 workshops on the program for this congress, the participation of the Quebec Division of the Association of the Canadian Bar, which will present the Litigant’s ethics workshop… it will be no cakewalk with lecturer Maître Sylvain Lussier.
