Les tribunaux québécois sont de plus en plus encombrés par des justiciables qui lancent des procédures à tort et à travers et utilisent ainsi le système judiciaire pour leur satisfaction personnelle. Le droit et la psychiatrie les appellent des « quérulents ».

The Québécois courts are more and more encumbered by the justiciable ones which launch procedures wrongly and through and thus use the legal system for their personal satisfaction. The right and psychiatry call them “quérulents”.

Selon Sylvette Guillemard, membre du Barreau du Québec et professeure à l’Université Laval, plusieurs dizaines de requêtes non fondées sont actuellement sur le bureau des juges.

According to Sylvette Guillemard, member of the Bar of Quebec and professeure at the Laval University, several tens of nonfounded requests are currently on the desk of the judges.

Spécialiste de la question sur laquelle elle a donné une conférence à l’Université du Luxembourg le 10 juillet dernier, elle indique que les raisons expliquant l’augmentation de ce fléau restent inconnues alors qu’il n’y a pas eu de changement structurel dans le système judiciaire.

Specialist in the question about which it gave a conference to the University of Luxembourg on July 10th, it indicates that the reasons explaining the increase in this plague remain unknown whereas there no was structural change in the legal system.

Mais quelles sont les points communs de ces plaideurs abusifs ?

But which are the common points of these abusive litigants?
Notes: stupid question. It should be, DO they have points in common, not WHAT are the points? They’re skipping the basics in order to fabricate a new category and toss in anyone they want.

Sylvio Langevin qui réclamait la propriété de la Lune et de plusieurs planètes dont la Terre, Andy Srougi, membre de Fathers 4 Justice, qui se battait pour la garde de ses enfants, ou encore Valery Fabrikant, ex-professeur à l’Université Concordia emprisonné pour avoir tué quatre de ses collègues en 1992, sont quelques uns des quérulents devenus célèbres pour leurs frasques judiciaires.

Sylvio Langevin which claimed the property of the Moon and several planets whose Earth, Andy Srougi, member of Fathers 4 Justice, which fought for the guard of his/her children, or Valery Fabrikant, ex-professor at the Concordia University imprisoned to have killed four of his/her colleagues in 1992, are some of the quérulents become famous for their legal escapades.

Le profil type du quérulent : un homme entre 40 et 60 ans qui est en demande et se représente seul. « Un peu prétentieux, il sait mieux que l’avocat ce qu’il faut faire », indique Me Guillemard.

The standard profile of quérulent: a man between 40 and 60 years which is in request and only represents himself. “A little pretentious, it knows better than the lawyer what it is necessary to make”, indicates to Me Guillemard.

Bien que la quérulence révèle une maladie mentale – la paranoïa le plus souvent – il n’est pas nécessaire de produire une preuve médicale de l’état devant la cour. Plusieurs décisions – dont Barreau du Québec c. Srougi – ont répertorié les indices qui permettent de déterminer si un justiciable est quérulent.

Although the quérulence reveals a mental disease – paranoia generally – it is not necessary to produce a medical proof of the state before the court. Several decisions – of which Barreau of Quebec C. Srougi – indexed the indices which make it possible to determine if a justiciable east quérulent.

Plusieurs caractéristiques

Il formule des requêtes farfelues, souvent non fondées en droit, et multiplie les procédures sur le même sujet malgré des échecs répétés, incapable alors d’assumer les frais judiciaires qui en découlent.

« Les montants réclamés sont exorbitants, comme 200 millions de dollars pour un événement de moindre importance », souligne la professeure.

Par ailleurs, « ayant le goût du théâtre, il est indomptable en audience et fait son show. Son langage est assez peu courtois et parfois châtié surtout envers les juges qu’il discrédite. Il s’en prend aux gens de justice en général ».

Pour être un quérulent, il n’est pas nécessaire de présenter toutes ces caractéristiques. À l’inverse, un ou deux symptômes ne fera pas de votre client un plaideur abusif. Certains caractères sont plus importants que d’autres, comme le nombre de demandes sur la même question.

Préserver l’accès à un juge

La quérulence se rencontre plus souvent dans les juridictions de Common Law que dans les systèmes civilistes, et surtout devant les tribunaux où la représentation par avocat n’est pas obligatoire, ce qui est le cas en général au Québec, sauf exception. « L’accès au juge qui est un droit fondamental est donc facile et personnel », explique la professeure.

The quérulence more often meets in the jurisdictions of Common Law than in the systems common lawyers, and especially in front of the courts where the representation by lawyer is not obligatory, which is the case in general in Quebec, except exception. “The access to the judge who is a basic right is thus easy and personal”, explains professeure.

Elle ajoute que dans la société québécoise, le citoyen dispose d’une grande liberté de parole, encouragé dès le plus jeune âge à manifester son mécontentement.

She adds that in the Québec society, the citizen has a great freedom of speech, encouraged as of more the young age to express her dissatisfaction.

Par ailleurs, le comportement du quérulent a des conséquences financières néfastes tant pour lui que pour ses adversaires et l’administration judiciaire encombrée.

In addition, the behavior of quérulent has harmful financial consequences as well for him as for its adversaries and the encumbered legal administration.

Les juges sont ainsi prudents quand il s’agit de qualifier un justiciable de quérulent, l’objectif étant de trouver l’équilibre entre le droit fondamental d’une personne de s’adresser aux tribunaux et le souci d’éviter les abus des ressources judiciaires.

The judges are thus careful when it is a question of qualifying justiciable to quérulent, the objective being to find balance between the basic right of a person of asresser with the courts and the concern of avoiding the abuses the legal resources.

Une piste de solution

Dans le droit actuel, les articles 54.1 et suivants du Code de procédure civile permettent aux juges de sanctionner les abus de procédure d’une partie.

In current law, articles 54.1 and following of the Code of civil procedure make it possible to the judges to sanction the abuses procedure of a part.

En plus de sanctions pécuniaires et du rejet de la procédure, un plaideur déclaré quérulent pourrait se voir interdire l’introduction d’une nouvelle demande en justice sans l’autorisation d’un juge. « La levée de la déclaration de quérulence peut être demandée mais je n’ai jamais vu quelqu’un y accéder, la paranoïa du quérulent s’aggravant avec l’âge », souligne la spécialiste.

In addition to pecuniary penalties and rejection of the procedure, a declared litigant quérulent could see himself prohibiting the introduction of a new action at law without the authorization of a judge. “The lifting of the declaration of quérulence can be required but I never saw somebody reaching it, the paranoia of quérulent worsening with age”, underlines the specialist.

L’une des caractéristiques communes des quérulents étant « l’auto-représentation », la professeure propose de modifier l’article 61 du Code de procédure civile en ajoutant le quérulent à la liste des catégories de personnes obligées d’être représentées par un avocat, ce qui constituerait un barrage supplémentaire.

One of the common characteristics of the quérulents being “the car-representation”, the professeure proposes to modify article 61 of the Code of civil procedure while adding quérulent it with the list of the categories of people obliged to be represented by a lawyer, which would constitute an additional stopping.

Son projet risque de déplaire aux défenseurs radicaux du droit fondamental de s’adresser à un juge, confie-t-elle, ce à quoi elle répond que « ce droit est préservé et son exercice passe par une personne qui connaît mieux le droit. »

Toutefois, à l’instar de certains médecins qui sont réticents à prodiguer des soins aux quérulents de peur d’être poursuivis, les avocats pourraient aussi craindre de les représenter.

Mais pour Me Guillemard, l’obligation de passer par un juge pour initier toute procédure devrait permettre de lever cette inquiétude.

Son projet a déjà été reçu positivement par certains de ses collègues et juges et elle espère qu’il trouvera bientôt écho auprès du législateur dans le cadre d’une modification du Code de procédure civile.
